The Robinett contract was clearly stated, revised and understood by both parties. I had a detailed scope that outlined what would be done for the contract amount and, as early as the rough framing section of the project, she began asking for changes and modifications that were not part of the contract. After allowing my crews to succumb to the continual requests for the first 2 weeks, I stopped the 'free add on' train and only my painters fell prey to it after that. Counting the add ons (which were allowed by me and not charged for) and the contract work, all monies collected were spent on her job. Each job that i build/remodel has a separate account set up for it. Monies are allocated for each trade, vendor, insurances and other overhead. All monies collected were spent, and more, and it was no longer feasible for me to continue. I called inspection's services and discussed the matter with the head inspector and he agreed that i needed to cancel the contract and pull the permit. As of now, i've not pulled the permit, but obviously there's no recourse now.

The 'poor craftsmanship' was because we weren't allowed to finish the job b/c of her failure to pay as the contract stipulated. I have a 'pay as you go' contract because I don't have any accounts with vendors or subs so there will never be a lien on the property. I clearly explained this to her (and all clients) b/c cash flow is the life blood of my business and didn't want to have any confusion as to my "Pay at the beginning of..." pay schedule. In spite of numerous attempts to 'restart' the project with a modified schedule, she continued to balk at paying another dime until completion was near. Finishing the windows, paint, and interior finishes was not possible b/c my crews refused to keep working without getting paid (I guess i'm not alone in this regard). Although i hate having dissatisfied clients, there's nothing i could do to avoid this. I hope this explanation can assuage any hesitation one might have..
